IN CONSIDERATION OF myself and my child/ward/minor(s) being allowed to participate in any way in Triple Crown Training, LLC events and activities, I, the undersigned, acknowledge, appreciate, and agree to the following:

Assumption of Risk:

I understand that participating in activities at Triple Crown Training, LLC involves inherent risks, including but not limited to physical injury, property damage, and other potential hazards. I voluntarily assume all risks associated with my/my child's participation in these activities.

Release of Liability:

In consideration of being allowed to use the facilities and participate in activities at Triple Crown Training, LLC, I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release, indemnify, and hold harmless Triple Crown Training, LLC, its owners, employees, agents, representatives, and licensor (Top Velocity Performance Centers, LLC), from any and all claims, demands, losses, or liabilities arising out of or related to any injury, disability, or loss to person or property incurred as a result of my/my child's participation in these activities, whether arising from the negligence of the releases or otherwise.

Pre-Existing Conditions and Injuries Clause:

I acknowledge and agree that I/my child/ward will disclose any pre-existing medical conditions, injuries, or illnesses to Triple Crown Training, LLC prior to participating in any activities or events. I understand and agree that Triple Crown Training, LLC, its owners, employees, agents, and representatives are not responsible for any pre-existing conditions or for any aggravation or worsening of such conditions that may occur as a result of participation in activities or events at Triple Crown Training, LLC.

Parental Consent (for minors):

As the parent/guardian of the minor participant, I consent to my child's participation in activities at Triple Crown Training, LLC. I understand the risks involved and agree to release, indemnify, and hold harmless Triple Crown Training, LLC from any claims arising out of my child's participation.

Acknowledgment of Policies:

I have read and agree to abide by the facility's rules and regulations, rental policies, and health and safety guidelines.

Marketing, Internet & Photo Release Form for Adults & Minors

I hereby grant permission to Triple Crown Training, LLC to use my and my minor(s)' image, likeness, and voice as recorded on audio or video without payment or any other consideration. I understand that our images may be edited, copied, exhibited, published, or distributed and waive the right to inspect or approve the finished product. Additionally, I waive any right to royalties or other compensation arising from or related to the use of our images or recordings. I also understand that this material may be used in diverse educational settings within an unrestricted geographic area. Photographic, audio, or video recordings may be used for any purpose, including but not limited to: presentations, courses, online videos, media, and news.

I irrevocably authorize Triple Crown Training, LLC to copy, edit, enhance, crop, or otherwise alter any photos for use in their publications. I waive any rights to approve or inspect said photos, which are the property of Triple Crown Training, LLC and will not be provided to me.

By signing this release, I understand that photographic or video recordings of me and my minor(s) may be electronically displayed via the internet or in public educational settings. I will not be consulted about the use of the photographs or video recordings for any purpose other than those listed above. There is no time limit on the validity of this release, nor is there any geographic limitation on where these materials may be distributed. This release applies to photographic, audio, or video recordings collected as part of the sessions listed on this document only. I have carefully read and fully understand all the provisions of this photo release form and am freely, knowingly, and voluntarily signing. By signing, I acknowledge that I have completely read and fully understand the above release and agree to be bound by its terms. I hereby release any and all claims against any person or organization utilizing this material for educational purposes.

Safety Guidelines:

• Helmets must be worn at all times in batting cages.

• No running in the facility.

• Proper use of equipment is mandatory.

• Follow the instructions of staff and coaches.

Code of Conduct:

• Respectful behavior towards staff and other participants is required.

• No use of foul language or disruptive behavior.

• Minors must be supervised.

Supervision:

Minors must be supervised by an adult unless participating in a supervised training session.

Rental Policies:

Booking Procedures:

• Reservations can be made online or by phone.

• Payments must be made in advance.

Cancellation Policies:

• Cancellations must be made at least 72 hours in advance for a full refund.

• No-shows or late cancellations will not be refunded.

Payment Terms:

• Payments are due at the time of booking.

• Accepted forms of payment include credit cards and checks.

Duration and Time Limits:

• Rentals are available on a half-hour or hourly basis.

• Participants must vacate the cage promptly at the end of their rental period.

Refund Policies:

• No refunds are provided for virtual training programs once access is granted.

• For damaged merchandise, customers can request a replacement by submitting a photo of the damage before returning the product. The customer is responsible for shipping costs for replacement items.

Health and Safety Policies:

Emergency Procedures:

• First aid kits are available at the front desk.

• In case of emergency, contact staff immediately.

Hygiene and Sanitation:

• Equipment is sanitized regularly.

• Hand sanitizers are available throughout the facility.

• Participants are encouraged to bring their own water bottles and towels.

COVID-19 Protocols:

• Masks are optional but encouraged for unvaccinated individuals.

• Maintain social distancing where possible.

• Follow all local health guidelines and regulations.

Privacy Policy:

Collection of Information:

• Personal information is collected for the purpose of providing training and rental services.

• Information collected includes names, addresses, phone numbers, and medical information.

Use of Information:

• Personal information is used solely for providing services and ensuring the safety of participants.

• Information is not shared with third parties without consent.

Storage of Information:

• Personal information is stored securely.

• Access is limited to authorized personnel.

Privacy Rights:

• Participants have the right to access and correct their personal information.

• Concerns about privacy practices can be addressed to the management of Triple Crown Training, LLC.

Acknowledgment of Risks and Liability Waiver: I have read and fully understand the information provided above, and I am aware of the special dangers and risks inherent in the activity, including physical injury, death, and other consequences that may arise or result directly or indirectly from the activity. Being fully informed of these risks and in consideration of the privilege of participating in the described activities, I hereby assume all risks of injury or liability and waive any right of recovery from or to bring suit against Triple Crown Training, LLC and its affiliates, including camp organizers, sponsors, supervisors, coaches, and other participants, for any personal injury, death, or consequences arising out of my participation or my child’s participation in the activity. As the parent or guardian of the participant, I give my permission for any necessary emergency treatment at any camp facility. I authorize any hospital, emergency medical facility, and/or physician to perform emergency treatment for any injuries resulting from participation in Triple Crown Training, LLC activities.
